Undercover Investigation Leads To Doctor’s Arrest Illegal Prescribing, Sexual Battery

TEMECULA- Investigators with the Medical Board of California's (MBC) Prescription Drug Task Force arrested a physician at his office in Temecula November 13, 2013 for allegedly illegally prescribing drugs and sexual battery.

Investigators went undercover after a patient complained about Dr. David Kapelusznik.  Kapelusznik was arrested after investigators found evidence he prescribed a controlled substance without a  legitimate medical purpose.  There were also charges of sexual battery based on a complaint that Dr. Kapelusznik was performing inappropriate exams.

"I commend our California Statewide Law Enforcement Association (CSLEA) members who, on a daily basis,  work diligently to uncover what goes on in the exam rooms and offices of physicians who have no regard for the laws in place for the medical profession," said CSLEA President Alan Barcelona.  "It takes courage on behalf of a patient to contact the state and MBC  investigators are sympathetic to that."

Dr. Kapelusznik was booked at the Southwest Detention Center and bail was set at $125,000.  Investigators are asking anyone who may have been a victim to contact the Medical Board of California.
