YUBA COUNTY – On January 28, 2025, a Yuba County jury found Charles Duane Brewer, Jr. guilty of three counts of sodomizing a child under 10 years of age, two counts of using a minor to create child pornography, one count of possession of child pornography, one count of criminal threats, and one count of battery on a spouse. Brewer, who remains in custody, is scheduled to be sentenced on March 3, 2025. He faces up to 80 years to life in prison.
Brewer was arrested on January 3, 2024, after a woman discovered videos of child sex abuse involving her young daughter on Brewer’s phone and confronted him. The woman was dating Brewer at the time. Brewer hit the woman in the head, grabbed his cellphone from her, and fled the home. Ninety minutes after the woman’s phone call to 911, Brewer was spotted in Oroville and taken into custody. Brewer had hidden his cellphone in the headliner of his vehicle, but arresting deputies found it and preserved it as evidence.
Brewer’s phone was forensically examined with the assistance of the Sacramento Valley Hi-Tech Crimes Taskforce. Detectives located two videos Brewer made in the fall of 2023 of him sexually abusing the young girl. Brewer’s phone also had nearly 1000 images of graphic child porn, including images of children being sexually assaulted by animals.
The child who was abused underwent a sexual assault examination where evidentiary samples were collected and later analyzed by a California Department of Justice criminalist. The criminalist discovered trace amounts of foreign DNA in the samples. Despite having extremely limited DNA material, Criminalist Miguel Macias testified that he was able to determine it was 170 times more likely than not that the limited DNA sample was Brewer’s.
In the Yuba County District Attorney’s Office press release, the office expressed extreme gratitude to the deputies involved in the investigation, Criminalist Macias, the mother and daughter who testified, the prosecuting attorneys and the jury, all of whom were exposed to horrific details of the case. A person who had been sexually assaulted by Brewer in the past also testified.
