UKIAH – On December 18, 2025, a Mendocino County Superior Court jury found Brian Axel Martinez, 32, of Ukiah, guilty of second offense DUI driving. Martinez was found guilty of misdemeanor driving of a motor vehicle while under the influence of alcohol and misdemeanor driving a motor vehicle with a blood alcohol concentration of .08 or greater.
This was Martinez’s second trial stemming from a roll-over crash on Vichy Springs Road and his subsequent arrest by the CHP in October 2024. Martinez’s first trial in October 2025 ended in a mistrial, setting the stage for a December retrial.
This is a second offense for Martinez. He was also convicted for driving a motor vehicle with a blood alcohol concentration of .08 or greater in 2018.
The law enforcement agencies that provided testimony at the retrial were the California Highway Patrol and the California Department of Justice Forensic Laboratory.
“We are grateful for the efforts to keep drunk drivers and repeat drunk drivers off of our roadways, so that we can be safe as we travel with our families to schools, stores, restaurants, work and home,” said California Statewide Law Enforcement Association (CSLEA) President Alan Barcelona. “We in particular would like to thank the criminalists at California DOJ for assisting with DUI investigations and testifying in court when called upon.”
